1. General terms and conditions
By engaging our web services, you enter into a binding agreement with ADT Mode. These Terms, along with any additional agreements or policies referenced herein, constitute the complete agreement between you and ADT Mode regarding the services provided.
ADT Mode offers a range of web services, including but not limited to website design, development, hosting, maintenance, and domain registration. The specific details and scope of services will be outlined in the corresponding service agreement or proposal.
2. Data Processing Agreement
The data exchange between ADT Mode and their customers may contain privileged or confidential information (passwords, addresses, payment details… etc.). Please be advised that unauthorized use, disclosure, or copying of this information is prohibited by law.
In accordance with European regulations on Data Protection, Regulation (EU) 2016/679, and the Spanish Organic Law 3/2018 of December 5th, together with Law 34/2002 of July 11, LSSI, we inform you that your electronic contact information will be used for the purpose of sending generic information and contacts. In case of any issues, you have the right to access, rectify, oppose, delete, and port your personal data by submitting a document that identifies you to info@adtmode.com.
3. Intellectual property
Unless otherwise stated in the service agreement, all intellectual property rights, including copyrights, trademarks, and any other proprietary rights related to the web services provided by ADT Mode, shall remain the property of ADT Mode. You are granted a limited, non-exclusive license to use the deliverables solely for your intended purpose.
Upon payment of fee and expenses, the customer is granted a non-exclusive right to use the developed software. At the Customer’s request, the source code for the project may be disclosed to the extent feasible. However, the source code is strictly limited to further development of the specific project and must not be shared with any third party. Any expenses associated with disclosing the source code will be invoiced separately by ADT Mode. Please note that ADT Mode is not obligated to disclose the source code.
4. Payment and pricing
The pricing for our web services will be outlined in the service agreement or proposal. You agree to pay the agreed-upon fees in a timely manner as specified in the payment terms. Failure to make timely payments may result in the suspension or termination of services.
The customer may be invoiced by ADT Mode on a monthly basis, based on the progress made in the project or upon completion of specific project phases or elements. ADT Mode retains the right to invoice the Customer for any project it has worked on during a given month, regardless of its completion status.
5. User-generated Content
Our website may allow users to submit or post content, such as comments, reviews, or other materials. By submitting content, you grant us a non-exclusive, royalty-free, perpetual, irrevocable, and worldwide license to use, reproduce, modify, adapt, publish, distribute, and display the content for any purpose. You represent and warrant that you own or have the necessary rights to grant this license.
6. Work Showcase Authorization
By engaging our services, you grant us permission to showcase the work we have completed for you. With your consent, we may display and discuss the project on our website, portfolio, social media platforms, or other marketing materials for promotional purposes.
We respect your confidentiality and privacy. If you have any concerns regarding the disclosure of specific details or if you wish to maintain the confidentiality of certain aspects of the project, please inform us in writing. We will diligently adhere to your preferences and ensure that sensitive information remains confidential.
